
On November 20, 2025, the BPC adopted a new section of Chapter 363-116 WAC, Pilotage Rules, to establish tug escort requirements for laden oil tankers between 5,000 and 40,000 deadweight tons, barges and articulated tug barges greater than 5,000 deadweight tons. The adopted rule closes critical safety gaps for vessels carrying oil in bulk, reducing the risk of a catastrophic oil spill in Puget Sound and helping to protect wildlife, including endangered South Residence Killer Whales, fisheries, public health, and Washington's economy.
The new rule keeps the tug escort requirements in Rosario Strait and waters east, as codified by statute in 2020, and expands approximately 29 square miles to the northwest towards Patos Island. The new rules do not require tethering, but rather a mandatory discussion of the tethering plan via a pre-escort conference as defined in WAC 363-116-600(7).
The BPC’s definition of oil, as outlined in the Interpretive Statement, includes fats, oils, or greases of animal, fish, or marine mammal origin; vegetable oils, including oil from seeds, nuts, fruits, or kernels. A vessel carrying any of these types of oil is required to take a tug escort in the tug escort area.
The intention of the pre-escort conference is to ensure that the details of the transit are understood and agreed upon by those in command of each vessel. A list of the pre-escort conference topics should be available for reference at each conference. The logbook can acknowledge that it was completed utilizing the list and does not need to go into the specifics of each topic.
